These Terms of Use ("Terms") govern your access to and use of the website located at creative.formintel.co (the "Site"), operated by Form Intel, LLC, a South Carolina limited liability company, through its creative and marketing department, form.creative & marketing ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms should be read together with our Privacy Policy (creative.formintel.co/privacy), which is incorporated into these Terms by reference.

1. Use of the Site

1.1 Permitted Use. You may use the Site for lawful purposes only, including browsing information about form.creative & marketing's services, submitting a project-intake or consultation form, and scheduling meetings through any scheduling functionality we make available.

1.2 No Account Required. The Site does not require account creation or registration. Your use of the Site and submission of any form does not create an account or ongoing access relationship.

2. Prohibited Conduct

You agree not to: (i) use the Site for any unlawful purpose or in violation of any applicable law or regulation; (ii) scrape, crawl, spider, or use any automated means to access the Site or extract data from it without our prior written consent; (iii) interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or any networks connected to it; (iv) submit false, misleading, or fraudulent information through any form or other means; (v) use the Site to solicit or gather competitive intelligence, pricing information, or proprietary business information for the benefit of a competing service; (vi) copy, reproduce, distribute, modify, or create derivative works of any Site content without our prior written permission; (vii) attempt to reverse-engineer, decompile, or disassemble any aspect of the Site; or (viii) impersonate any person or entity or misrepresent your affiliation with any person or entity.

3. Intake Submissions

3.1 Inquiry Only. Submitting a project-intake or consultation form or scheduling a meeting through the Site constitutes a request for information. It does not create a binding agreement, an obligation to purchase services, or a client relationship between you and Form Intel, LLC.

3.2 Engagements. Creative and marketing engagements, including projects and Continuum partnerships, are governed exclusively by a separately executed engagement agreement. Descriptions of services, levels, and investment ranges on the Site are informational and do not constitute an offer.

4. Intellectual Property

The Site and all content on it, including text, design, graphics, logos, wordmarks, and the form. brand system, are the property of Form Intel, LLC or its licensors and are protected by intellectual-property laws. Nothing in these Terms grants you any right, title, or interest in the Site or its content.

5. Disclaimers

The Site is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

6. Limitation of Liability

To the fullest extent permitted by law, Form Intel, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim arising out of these Terms or the Site will not exceed one hundred dollars ($100).

7. Indemnification

You agree to indemnify and hold harmless Form Intel, LLC and its members, managers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

8. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.

9. Governing Law and Venue

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in South Carolina, and you consent to their jurisdiction.
