This Privacy Policy explains how Form Intel, LLC, a South Carolina limited liability company ("form.creative & marketing," "we," "us," or "our"), collects, uses, shares, and protects information through the website located at creative.formintel.co and related project-intake and consultation forms (collectively, the "Site"). form.creative & marketing is the creative and marketing department of Form Intel, LLC.
This Privacy Policy should be read together with our Terms of Use (creative.formintel.co/terms). By using the Site, you acknowledge that you have read and understood this Privacy Policy.
1. Information We Collect
1.1 Information You Provide. When you submit a project-intake or consultation form or otherwise contact us, we may collect: (i) contact details, including your name, email address, and organization; (ii) project details, including the disciplines involved, objectives, timeline, investment range, project description, and any links you provide; and (iii) any other information you choose to include in your submission or correspondence.
1.2 Information Collected Automatically. When you visit the Site, our servers and hosting infrastructure (currently Vercel) may automatically collect limited technical data, including: (i) IP address; (ii) browser type and version; (iii) operating system; (iv) referring URL; (v) pages visited and time spent on each page; and (vi) date and time of access (collectively, "Log Data").
1.3 Cookies. The Site uses only essential cookies required for the Site to function, including those set by our hosting provider. If we add non-essential cookies in the future, we will update this Privacy Policy and, where required by applicable law, obtain your consent before placing those cookies.
1.4 No Sensitive Information. We do not knowingly collect sensitive personal information such as financial account numbers, government identifiers, health information, or information revealing racial or ethnic origin, political opinions, or religious beliefs.
2. How We Use Your Information
We use the information we collect for the following purposes: (i) to respond to your inquiry and scope your project or engagement; (ii) to follow up regarding a potential or active engagement; (iii) to operate, secure, maintain, and improve the Site; (iv) to comply with applicable legal obligations; and (v) to enforce our rights arising from any agreements between you and us.
3. How We Share Your Information
3.1 Service Providers (Sub-Processors). We share information with third-party service providers that assist us in operating the Site and conducting our business, solely to the extent necessary for them to perform services on our behalf. As of the Effective Date these include: (i) Vercel, website hosting and infrastructure; (ii) Resend, delivery of transactional and lead-notification email; and (iii) monday.com, the platform we use to receive and manage inquiries submitted through the Site. These providers are permitted to use your information only to provide services to us and are bound by their own privacy and security commitments. We may add or change sub-processors as our tooling evolves and will update this list accordingly.
3.2 Legal Requirements. We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
3.3 Business Transfers. In the event of a merger, acquisition, reorganization, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such change by updating this Privacy Policy.
3.4 No Sale of Personal Information. We do not sell, rent, or trade your personal information to third parties for their marketing purposes. We have not sold personal information in the preceding twelve (12) months.
4. Data Retention
We retain intake-form submissions and related personal information for as long as reasonably necessary to evaluate and pursue a potential engagement and to meet our legal, accounting, or record-keeping obligations. Once the information is no longer needed for these purposes, we will delete or de-identify it. You may request deletion of your information at any time as described in Section 6.
5. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, alteration, or destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
6. Your Rights and Choices
6.1 General Rights. Regardless of your location, you may at any time: (i) request access to the personal information we hold about you; (ii) request correction of inaccurate information; (iii) request deletion of your information; or (iv) decline to provide information, though doing so may limit our ability to respond to your inquiry. 6.2 Identity Verification. Before processing any access, correction, or deletion request, we will verify your identity by confirming that the request originates from the email address associated with your original submission or correspondence. If you contact us from a different email address, we may ask you to provide sufficient identifying information to match your request to the data on file.
6.3 Response Timeline. We will acknowledge receipt of your request within five (5) business days and will complete the request within thirty (30) calendar days of receipt. If we require additional time, we will notify you in writing of the extension and the reason for it before the initial thirty-day period expires. Any extension will not exceed an additional thirty (30) calendar days.
6.4 Rights Under the General Data Protection Regulation (GDPR). If you are located in the European Economic Area, the United Kingdom, or Switzerland: (a) we process your personal data on the bases of legitimate interest (to respond to your inquiry, evaluate a potential engagement, and operate and improve the Site) and legal obligation (to comply with applicable laws); (b) in addition to the rights in Section 6.1, you have the right to restrict or object to our processing, to request portability of your personal data in a structured, commonly used, and machine-readable format, and to withdraw consent at any time where processing is based on consent; (c) Form Intel, LLC is the data controller responsible for your personal data; (d) you have the right to lodge a complaint with a data-protection supervisory authority; and (e) your personal data is transferred to and processed in the United States, protected by appropriate safeguards, including standard contractual clauses where applicable.
6.5 Rights Under the California Consumer Privacy Act (CCPA). If you are a California resident: (a) in the preceding twelve (12) months we have collected identifiers (name, email, organization), commercial information (project details, investment range), and internet activity information (Log Data), collected from you directly and from automatic collection as described in Section 1; (b) you have the right to know the categories and specific pieces of personal information we have collected about you; (c) you have the right to request deletion, subject to certain exceptions; (d) we will not discriminate against you for exercising any of your CCPA rights; and (e) to exercise these rights, contact us at privacy@formintel.co. CCPA requests will be completed within forty-five (45) calendar days where applicable law requires that timeline.
7. Children's Privacy
The Site is not directed to individuals under the age of sixteen (16). We do not knowingly collect personal information from anyone under 16. If you believe we have collected information from a child under 16, please contact us at privacy@formintel.co and we will take steps to delete that information promptly.
8. Third-Party Links
The Site may contain links to third-party websites or services, including other Form Intel, LLC department sites. We are not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of any third-party site you visit.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Effective Date" at the top of this page. If we make material changes, we will provide notice through the Site. Your continued use of the Site after any changes constitutes your acceptance of the updated Privacy Policy.
